Terms of Service
Effective October 21, 2026
These terms are an agreement between you and Trey Keys ("we", "us"), who runs TCnotes (tcnotes.app). By creating an account or using TCnotes, you agree to them. If you don't agree, please don't use TCnotes.
The short version
- Your notes are yours. We only use them to run TCnotes for you and your team.
- Use TCnotes lawfully, and get consent where the law requires it when you record audio.
- Check your markers before final delivery. Timecode and transcripts can be off.
- Paid plans renew until you cancel, and you can cancel any time.
- TCnotes is provided as is, and our liability is limited.
1. Who can use TCnotes
You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission. If you use TCnotes for a company or other organization, you confirm that you can agree to these terms on its behalf.
2. Your account
Give accurate information when you sign up, keep your sign-in details secure, and let us know right away at support@tcnotes.app if you think someone else has used your account. You are responsible for what happens under your account.
3. Your content
You own the projects, recordings, notes and other content you create in TCnotes. You give us permission to store, copy, process (including transcribing voice notes) and display your content only as needed to run TCnotes for you and the teams you share it with. This permission ends when your content is deleted, apart from backup copies that expire as described in our Privacy Policy.
You are responsible for your content and for having the rights to it. Voice notes record whatever your microphone hears while you hold the button, so it's up to you to follow the laws that apply where you record, including getting consent from other people when it's required.
4. Acceptable use
When using TCnotes, you agree not to:
- Break the law, or upload content you don't have the right to use.
- Harass, threaten or harm others, or use TCnotes to store abusive or unlawful material.
- Try to access accounts, teams or data that aren't yours.
- Disrupt or overload the service, or get around plan limits or security measures.
- Use bots or scripts to abuse features such as voice transcription.
- Copy, resell or reverse engineer TCnotes, except where the law allows it.
5. Teams
Everyone on a team can see and edit the team's projects, recordings and notes. The team's owner and admins decide who joins and who is removed. Teams depend on the owner's plan: if the owner's paid plan ends, the team may no longer be able to start new recordings, but existing work stays available.
6. Plans and payments
The free plan includes one project and up to 5 recordings at a time; deleting a recording frees a slot. Paid plans add features such as more projects (up to 200), unlimited recordings, voice notes and teams. For paid plans:
- Paid plans are billed in advance, monthly unless you choose otherwise, through Stripe via Clerk.
- Your plan renews automatically until you cancel. You can cancel at any time from your account.
- When you cancel, you keep paid features until the end of the period you've paid for. We don't refund partial periods, except where the law requires it.
- Prices don't include taxes unless stated, and you're responsible for any that apply.
- We may change prices or what each plan includes. We'll give you notice before a change affects a plan you pay for, and you can cancel before it takes effect.
7. Timecode and transcript accuracy
TCnotes works hard to stamp notes on the right frame, but accuracy depends on things we don't control: your device's clock, your Tentacle and camera settings, your project's frame rate, and your Bluetooth and network connection. Voice transcripts can contain mistakes. Check your markers and notes before relying on them for final delivery. We aren't responsible for missed shots, missed notes or edits based on inaccurate markers.
8. Other products and devices
TCnotes works with products made by others, including Tentacle Sync devices, Adobe Premiere Pro, DaVinci Resolve and Final Cut Pro. We aren't affiliated with or endorsed by Tentacle Sync, Adobe, Blackmagic Design or Apple, and their names and trademarks belong to them. We can't guarantee TCnotes will keep working with every version of their products.
9. Changes to TCnotes
TCnotes is a new and evolving product. We may add, change or remove features, or pause or end the service. We'll try to give reasonable notice before removing something important, and if we shut TCnotes down we'll give you time to export your notes.
10. Ending your use
You can stop using TCnotes and ask us to delete your account at any time by emailing privacy@tcnotes.app. We may suspend or close your account if you break these terms or put the service or other people at risk. Where it's reasonable, we'll tell you first and give you a chance to export your notes. Sections 3, 7 and 11 to 14 still apply after your account is closed.
11. Disclaimers
TCnotes is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don't promise that TCnotes will be uninterrupted, error free or always accurate.
12. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data, footage or business opportunities, arising from your use of TCnotes. Our total liability for any claim relating to TCnotes is limited to the greater of the amount you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not all apply to you.
13. Indemnity
If someone brings a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows.
14. Governing law
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in South Carolina, unless the law where you live gives you the right to bring it elsewhere.
15. Changes to these terms
We may update these terms. We'll change the date at the top, and for significant changes we'll let you know in the app or by email before they take effect. Continuing to use TCnotes after that means you accept the updated terms.
